Terms of Use for GPSNet CORS Correction Service

1. Acceptance of Terms

By subscribing to and using the GPSNet CORS (Continuously Operating Reference Stations) correction service, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, please do not use this service.

2. Service Description

GPSNet provides Real-Time Kinematic (RTK) correction services through a network of reference stations. This service supports multiple satellite constellations, including GPS, GLONASS, Galileo, and BeiDou, to enhance positioning accuracy for subscribers in the Cape Town area and other designated regions.

3. Subscriptions and Billing

Subscription Plans

Prices include VAT and are subject to change without prior notice. The price that applies to a subscription is the price shown in the GPSNet Price List below as at the invoice date, as recorded on your tax invoice. RINEX data is priced per station per day (24 hours); part days count as a full day.

Subscription prices are per rover user. CHCNAV = existing CHCNAV GPS clients; OTHER = all other brands.

Special request RINEX options

Our standard RINEX product is 5 s, RINEX 3.04. On special request the following can be supplied:

• RINEX version: 2.10, 3.02 or 3.04
• Data interval: 1 s, 15 s, 30 s or 60 s
• Observables: pseudorange, carrier, SNR, Doppler
• Systems: GPS, GLONASS, BeiDou (BDS and BD3), Galileo, SBAS, QZSS

Special request data can be supplied if your order reaches us and is confirmed by reply email that such a request was received at least 3 working days before your planned survey.

RINEX data will only be provided if an order (Appendix A) is completed and sent to [email protected].

Billing: Billing for real-time correction services is prorated based on the expiry date of the initial company subscription. When adding usernames or rover instances on the same username after the start date of an active subscription, charges will be calculated based on the remaining period of the initial subscription.
RINEX data files will be billed and paid for after the order is received and before the delivery is completed.

Bulk Discounts: Discounts apply to bulk orders on the same invoice: Rover 1 (full price), Rover 2 (10% discount), Rover 3 (20% discount), Rover 4 (30% discount), and Rover 5 and more (40% discount). Please email [email protected] for a quotation if you have need for multiple rovers.

No discounts applicable to RINEX data orders.

Refunds: No refunds will be given for any subscription that is cancelled or not used by the customer. MMS Design will fully refund any incomplete or unfulfilled RINEX data orders.

4. User Accounts

Upon subscription, GPSNet will issue a unique username and password for each rover. Users are responsible for maintaining the confidentiality of their account information and are fully responsible for all activities that occur under their account.

5. Service Availability and Uptime

We strive to maintain a 100% service uptime. However, GPSNet does not guarantee uninterrupted service and is not responsible for any downtime due to maintenance, network issues, or other factors beyond our control, especially Eskom power outages or cell phone data coverage limitations or constraints.

6. Acceptable Use

Users agree to use the GPSNet service for lawful purposes only. The service must not be used in any way that:

• Violates any local, national, or international law or regulation.
• Infringes upon the rights of others.
• Interferes with or disrupts the service or servers.

7. Data Privacy

GPSNet is committed to protecting your privacy. We collect and use your data in accordance with our Privacy Policy. By using our service, you consent to such collection and use. We will not make your details available to any third parties, in accordance with the POPI Act.

8. Limitation of Liability

GPSNet will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the service. Our total liability under this agreement shall not exceed the amount paid by the user for the current subscription.

9. Modifications to Terms

GPSNet reserves the right to modify these terms at any time. Subscribers will be notified of any changes at the email used during initial registration, and continued use of the service constitutes acceptance of the revised terms.

10. Termination

GPSNet may terminate or suspend your access to the service without notice for conduct that it believes violates these terms or is harmful to other users. Upon termination, all rights granted to you will cease immediately.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.

Acceptance

By subscribing to and using the GPSNet CORS correction service, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

New subscribers confirm acceptance by completing and signing the GPSNet acceptance form and returning it as a PDF to [email protected]. Without a signed and completed form, we reserve the right to cancel your subscription without notice.

Appendix A: RINEX Data Order

IMPORTANT! Our server stores 5 s RINEX 3.04 data files for the past 14 days only. Data older than 14 days is deleted automatically. Please get your order in before the data expires. Special orders must be confirmed at least 3 working days before the survey.

Email your order to [email protected] with the following:

• Company name, full name, email and contact number
• RINEX data start date and time, and end date and time
• Station(s) required: STBS Stellenbosch, PLSD Plumstead, DBVL Durbanville, MALM Malmesbury, PRET Pretoria (Waterkloof), KEMP Kempton Park, KRUG Krugersdorp, MBAY Nelson Mandela Bay, BRTZ Brits
• Option 1: standard 5 s RINEX 3.04, or Option 2: special order RINEX (state version, interval, observables and systems from the list in section 3). Both are priced per station per day in the Price List.
